Im Juli 2013 schlug die Europäische Kommission, im Rahmen der geplanten Bankenunion, eine VO vor, dessen Inhalt die Regelung der einheitlichen Bankenabwicklung darstellt. Vielerseits wurden Bedenken angemeldet bezüglich der Rechtsgrundlage, welche Artikel 114 AEUV ist. In der Diplomarbeit wird dargestellt, warum eine Bankenunion für den Euroraum angedacht wurde, aus welchen Säulen die Bankenunion besteht und es wird auf ihre Kompetenzgrundlagen eingegangen. Ziel der Arbeit war bzw. ist es rechtlich zu analysieren, ob die angemeldeten Bedenken begründet sind und so der Vorschlag dem EU- Recht widerspricht oder ob Artikel 114 AEUV eine solide Rechtsgrundlage darstellt. Es werden aber auch (Ausweich-) Möglichkeiten aufgezeigt, sollte Artikel 114 AEUV keine solide Rechtsgrundlage sein. |

In July 2013 the European Commission submitted a proposal of a regulation for a Resolution Mechanism, which would constitute one part of the Banking Union. The European Commission has been criticized with r4egard to this proposal for its legal basis which is Article 114 TFEU. This paper describes why a Banking Union was wanted in Europe, it describes the pillars of the Banking Union and the legal basis of the pillars. The special purpose of this paper is a legal analysis whether Article 114 TFEU constitutes a suitable and sufficient legal basis for the proposal or not. The paper also discusses other options of a legal basis should it turn out that Article 114 TFEU would not constitute a proper legal basis. |
