Die vorliegende Arbeit befasst sich mit der sprachlichen Revision der genannten Paragraphen. Das ABGB steht seit dem Jahr 1812 in Kraft, zahlreiche Normen stammen noch aus der Stammfassung. Durch die erheblichen Änderungen sowohl der Alltagssprache, als auch der juristischen Fachsprache in den letzten 200 Jahren, sind etliche dieser Bestimmungen heutzutage schwer verständlich. Auch Nebengesetze jüngeren Datums und mitunter erheblich vom Wortlaut abweichende Interpretationen haben dazu beigetragen, dass das Gesetzbuch mitunter veraltet wirkt. Diese Arbeit zielt darauf ab, modernere Formulierungen für die Paragraphen des Miteigentumsrechts vorzuschlagen, die zu einer besseren Lesbarkeit und Verständlichkeit dieses Rechtsbereiches führen sollen. Im ersten Teil wird der wesentliche Inhalt der Paragraphen dargelegt und anhand von einschlägiger Literatur und Judikatur interpretiert. Im Anschluss werden Konsequenzen für eine sprachliche Neufassung gezogen. Der zweite Teil steht im Zeichen der Neuformulierung der Normen. In Übersichtstabellen werden Originaltext und Neufassung der Paragraphen einander gegenübergestellt. Sofern zu einem Paragraphen zwei Vorschläge vorhanden sind, besteht der erste im Wesentlichen aus einer bloß linguistischen Modernisierung, wohingegen im zweiten auch inhaltliche Reformen wie die Kodifizierung anerkannter analoger Anwendungsfälle Platz finden. |

This thesis deals with the linguistic revision of the aforementioned paragraphs. The Austrian Civil Code has been in force since 1812, numerous norms date back to the initial version. Due to substantial modifications of general speech as well as legal terminology in the last 200 years, several of these provisions are difficult to understand nowadays. Ancillary laws of a younger date and interpretations which sometimes dissent substantially from the wording have contributed to the fact that this code of law sometimes seems outdated. The aim of this thesis is to propose more modern formulations for the paragraphs of the law of joint property, which shall lead to a better readability and understandibility of this area of legislation. In the first part, the essential content of the paragraphs is exposed and interpreted by means of relevant literature and judicature. Subsequently, the consequences for the linguistic revision are drawn. The second part is dedicated to the restatement of the norms. The original text and the restatement of the paragraphs are confronted with each other in synoptical tables. If there are two suggestions concerning one paragraph, the first basically contains a linguistic modernization, whereas there is also room for contentual reforms such as the codification of acknowledged analogous applications in the second suggestion. |
