In der Dissertation wird eingangs ein Kapitel den Vordenkern und Vätern des Eu-ropagedankens bzw. der Europäischen Gemeinschaften gewidmet.Dargestellt wird die ILO hinsichtlich ihrer Entstehung und Aussagekraft auf internationalem Gebiet. Rund 130 Übereinkommen und 130 Empfehlungen wurden gesichtet, um die sozialversicherungsrechtlichen Segmente herauszufiltern und zu skizzieren. Weiters wurde die Organisation kurz beleuchtet, ebenso die Charta der Vereinten Nationen.Angeführt wird der Internationale Pakt über bürgerliche und politische Rechte einschließlich der beiden Fakultativprotokolle zu diesem Pakt. Dasselbe gilt für den Internationalen Pakt über wirtschaftliche, soziale und kulturelle Rechte unter Einschluss des Fakultativprotokolls sowie der hiezu ergangenen Verfahrensordnung. Einer Durchsicht unterzogen wurde das Übereinkommen von New York über die politischen Rechte der Frau einschließlich Fakultativprotokoll und Verfahrensordnung.Es wird die Westeuropäische Union und die Europäische Menschenrechtskonvention untersucht, ebenso die Europäische Gemeinschaft für Kohle und Stahl. Weiters der Vertrag zur Gründung der Europäischen Atomgemeinschaft. Dies gilt auch für die European Free Trade Association.Die Europäische Sozialcharta, vom Europarat beschlossen mit Anhang bot eben-falls die Grundlage für die Ermittlung von sozialversicherungsrechtlichen Elementen.Der Vertrag zur Gründung der EWG unter Berücksichtigung der Verträge von Maastricht, Amsterdam, Nizza, Lissabon sowie der Vertrag über eine Verfassung für Europa werden ebenfalls einer Durchsicht nach sozialversicherungsrechtlichen Bestandteilen allgemeiner Art unterzogen. Berücksichtigung fand die Einheitliche Europäische Akte wie auch der Vertrag über den Europäischen Wirtschaftsraum.Die vier unterschiedlichen Systeme werden vergleichsweise dargestellt. Ein kurzer Hinweis auf außereuropäische Gemeinschaften, eine Gesamtzusammenfassung mit einem Ausblick bilden den Abschluss. |

Within the first chapters of the dissertation one chapter is being dedicated to the pioneers who developed the concept of Europe, respectively the Foundation of the European Community.This thesis also illustrates the origin of the ILO and shows its significance on international ground. Around 130 conventions and 130 recommendations have been sighted to filter and outline segments that include the Social Security Act. Furthermore the organization itself as well as the charter of the United Nations is being briefly examined.Additionally the International Convent on Civil and Political Rights, including both optional protocols regarding this convent are being mentioned within this work. The same applies to the International Convent on Economic, Social and Cultural Rights along with its optional protocol and rules of procedure. In addition to that the agreement of New York on the political rights of women including its optional protocol as well as its rules of procedure was also given a look through.Moreover the WEU and the WHO as well as the European Coal and Steel Community within the boundaries of the European Communities are being analyzed. This also extends to the Treaty on the European Atomic Energy Community as well as the EFTA. The European Social Charter, voted by the Council of Europe including the additional protocol as well as the exhibit, also served as a basis for finding more elements pertaining to the Social Security Act. The same applies to the Treaty on the European Economic Community whilst taking into account the Treaty of Lisbon, Treaty of Nice, Treaty of Maastricht and Treaty of Amsterdam as well as the Treaty supporting a European constitution. The Single European Act and the Treaty on the European Economic Area are also being considered in this dissertation.Finally the four divergent systems are being compared to one another. Non-European communities as well as a general summery including an outlook are briefly referenced along with it. |
