Zentrales Thema im ersten Teil der Arbeit ist die Auswirkung der OGH Entscheidung 3 Ob 45/12g auf das Zivilrecht. Insbesondere die möglicherweise zu erwartenden Folgeprobleme sind näher zu untersuchen. Um den Judikaturwandel genauer zu verstehen, wird die alte Rechtslage zur Veranschaulichung in Auszügen dem Leser näher gebracht. Da sich die Tragweite der Entscheidung nicht nur auf das Zivilrecht beschränkt, wird die Wirkung der Entscheidung auf das Arbeits-, Sozial-, Straf- und Gewerberecht untersucht. Im zweiten Teil der Arbeit, wird die Rechtsprechung des BGH im Zusammenhang mit körperlichen und nicht körperlichen Dienstleistungen bis zur gesetzlichen Regelung beleuchtet. Um die rechtliche Situation vor Inkrafttreten des Prostitutionsgesetztes im Jahr 2002 besser verstehen zu können, wird dem Leser eine Zusammenfassung der früheren Rechtslage geboten. Im Fokus des zweiten Teils der Arbeit steht das Prostitutionsgesetz 2002. Es wird sein Aufbau, seine Wirkung auf das Zivilrecht und die für die Regelung der Prostitution in Deutschland relevanten Rechtsgebiete erörtert. Am Ende soll es möglich sein, die beiden Rechtsordnungen einem Vergleich zu unterziehen, welcher Aufschluss über die jeweiligen Stärken und Schwächen im Hinblick auf die Rechtslage der Prostitution gibt. |

This paper examines prostitution legislation in both Austria and Germany and is divided into two sections accordingly. The first part of the paper looks at the effects that the Austrian Supreme Court ruling 3 Ob 45/12g will have on civil law, in particular focussing on the problems that are expected to arise. As the effects will reach beyond the boundaries of civil law, the impact it is expected to have on labour and employment law, criminal law and commercial law is also detailed. A summary of the situation prior to the new legislation is given in order to more clearly illustrate the changes that have been introduced. The second part of the paper analyses the jurisdiction of the German Federal Court of Justice relating to sexual services and non-sexual services. An introduction to the situation in Germany before (new) prostitution legislation was introduced in 2002 is given. The focus of the second part, however, lies on exploring the different elements of the legislation, the effect it has had on civil law, and the other fields of law relevant to prostitution regulation in Germany. The paper concludes by drawing parallels between the two legal systems, showing the strengths and weaknesses of the legal situation of prostitution. |
