In der vorliegenden Arbeit werden die urheberrechtlichen Aspekte der Musik- und TV- Wiedergabe in Arztpraxen thematisiert. Bei den Lesern soll ein grundlegendes Verständnis erzeugt werden, wann eigentlich eine öffentliche Veranstaltung im Sinne des Urheberrechts vorliegt ? mit speziellem Bezug auf die Berufsgruppe der Ärzte.Beispielsweise stellen sich hier praxisrelevante Fragen wie: ?Gilt ein Arzt als Veranstalter, wenn er seinen Patienten Musik aus dem Radio vorspielt? Ergibt sich daraus eine Gebührenpflicht und muss er in der Folge an die AKM ein Entgelt zahlen??Anfangs wird ein kurzer Überblick über die Entwicklung des Urheberrechts gegeben mit den wichtigsten nationalen Regelwerken und internationalen Abkommen, welche für diese Arbeit Bedeutung haben.Darauf folgend werden die grundsätzlichen urheberrechtlichen Aspekte der Musik- und TV- Wiedergabe behandelt, sowie eine konkrete Betrachtung des Urheberrechts in Arztpraxen vorgenommen. Ein wichtiger Bestandteil dieser Arbeit ist der Begriff der ?Öffentlichkeit?, bzw. die Frage, wann oder in welchen Fällen es sich um eine öffentliche Aufführung handelt.Den Kern dieser Arbeit stellt die EuGH- Entscheidung vom 15. März 2012, Rs C-135/10, Società Consortile Fonografici (SCF) vs Marco Del Corso, dar. Diese regelt konkret die Situation der Musikwiedergabe in einer Zahnarztpraxis und wird daher eingehend besprochen, diskutiert und daraus Schlussfolgerungen gezogen.

The aim is to give the reader a basic understanding of the subject., in what circumstances copyright issues come into play, especially in the field of medical practice.As an example, questions relevant to medical practice may include "is a doctor classed as an event organiser if he plays music on the radio to a patient? Does this lead to a liability to pay fees for the performance and therefore a duty to pay a fee to the performing rights organisation?"Initially a brief summary of the development of copyright will be given and detailing the most important national rules and international agreements.Then the basic aspects of copyright as they affect music and TV recording will be dealt with, as well as taking a specific look at the way copyright affects doctors' practices. An important part of this work is the meaning of the term "public", in particular under what circumstances a performance is classed as a public event.The core of this work is based on the EuGH decision of the 15th March 2012, Rs C-135/10, Società Consortile Fonografici (SCF) vs Marco Del Corso, This specifically lays down the rules regarding the reproduction of music in a dental practice and is therefore discussed in detail and from this relevant conclusions are drawn.
