Ziel der vorliegenden Arbeit ist es die Rechtsnatur von annehmbaren Nachweisverfahren (Acceptable Means of Compliance, AMC) und Begleitmaterial (Guidance Material, GM) herauszuarbeiten. Diese beiden Rechtsakte werden von der EASA, der europäischen Agentur für Flugsicherheit selbst ausgegeben und sind laut eigener Definition rechtlich nicht verbindlich. Der österreichische Verfassungsgerichtshof hat allerdings entgegen der Definition der EASA sowohl AMC als auch GM in seinem Erkenntnis einen verbindlichen Charakter zugeschrieben und in den Status von sekundären Unionsrecht gehoben.Grob in zwei Abschnitte unterteilt, behandelt der erste Abschnitt dieser Arbeit die delegierte Rechtssetzung. Der Zweite ist dem Luftrecht gewidmet. Es wird hier im Speziellen auf das Rechtssystem der EASA eingegangen sowie dessen Entwicklung kurz erläutert. Um der Frage der Rechtsnatur von Rechtsakten der Agentur nachzugehen ist es unabdinglich sich die Tätigkeitsbereiche von europäischen Agenturen insbesondere der EASA anzusehen. Man stößt hier auf den Begriff des Soft Law, der bei der Untersuchung der Rechtsnatur von AMC und GM eine zentrale Rolle spielt. |

The objective of this thesis is to define the legal nature of AMC (acceptable means of compliance) and GM (guidance material). These two legal acts are issued by the European aviation safety agency (EASA) but are not legally binding according to their own definition. However, contrary to the definition of the EASA, the Austrian constitutional court ascribed AMC and GM a legally binding character in one of its decisions and thereby raised them into the status of secondary Union law. Roughly divided into two parts, the first part of the thesis deals with delegated legal acts. The second part is dedicated to aviation law. In particular the legal system of the EASA and its evolution. To attend to the question of the legal nature of the legal acts of the agency, it is indispensable to have a look at the area of operations of European agencies especially of the EASA. Here the term soft law pounces up, which is an essential topic concerning the research of the legal nature of AMC and GM. |
