Diese Arbeit beschäftigt sich mit der Besteuerung der österreichischen Land- und Forst- wirtschaft und konkret wie sich die Zuwendungen aus öffentlicher Hand, speziell Zuwen- dungen aus der Säule I und Säule II der Gemeinsamen Agrarpolitik, auf das Steuersys- tem in der Land- und Forstwirtschaft im Einheitswert, in der Einkommensteuer und Um- satzsteuer auswirken. Aus methodischer Sicht werden anfangs die Rechtsgrundlagen und historische Entwick- lung sowie Inhalte der Säule I und Säule II der Gemeinsamen Agrarpolitik behandelt. Da- nach wird das Beihilfenrecht, hinsichtlich nationaler und europäischer Regelungen, be- leuchtet; wobei der Vertrag über die Arbeitsweise der Europäischen Union (AEUV) die maßgebliche Quelle bildet. Anschließend werden die Subventionen der Land- und Forstwirtschaft im Abgabenrecht im Hinblick auf die Einheitswertbewertung, Einkommensteuer und Umsatzsteuer darge- stellt, mit Fokus auf die Besteuerung des Einkommens, da dies im Steuerrecht gewis- sermaßen ein Sonderthema aufgrund der Pauschalierung darstellt. |

This thesis deals with the taxation of Austria’s agricultural and forestry sector and, espe- cially, how government grants, in particular grants from Pillar I and Pillar II of the Com- mon Agricultural Policy, affect the tax system in agriculture and forestry in terms of the assessed value, income tax and value added tax. The study design includes the legal bases, historical development and preconditions of taxation in the agricultural and forestry sector as well as the contents of Pillar I and Pillar II of the Common Agricultural Policy. Further the state aid rules, with regard to national and European regulations have been analyzed, primarily using the Treaty on the Func- tioning of the European Union (TFEU) as the relevant source. Afterwards, the subsidies of Austria’s agriculture and forestry are discussed in tax law; especially the valuation of assessed value, income tax and value added tax, with focus on the taxation of income, because this is certainly a special issue in tax law in terms of their consolidation into a lump sum. |
